2. General provisions
These Terms of Use, referred to below as the "Terms", govern the relationship between the provider under section 1, referred to below as the "Administrator", "we" or "us", and any natural or legal person visiting the website digitaldesigneu.com, referred to below as the "Site", or using the functionality offered through it, referred to below as the "User" or "you".
By visiting and/or using the Site, the User declares that they have read these Terms, accept them and agree to comply with them. If you do not agree with the Terms, please do not use the Site.
3. Scope of the Terms
These Terms govern the use of the Site as an information resource, the use of the Contact form, and card payments for Services already agreed.
These Terms neither replace nor limit separately concluded service agreements between the Administrator and its clients. The Administrator's Services — website development, SEO, Google Business Profile optimisation, Meta Ads and Google Ads campaigns, copywriting and other related digital services — are provided on the basis of an individual quotation and a separate agreement concluded in writing or by acceptance of a quotation by email.
The terms of those agreements prevail over these Terms in respect of the relevant service.
4. Definitions
For the purposes of these Terms, the following words have the following meaning:
- "Site" — the website digitaldesigneu.com, including all of its subdomains, pages, visual and textual content.
- "Content" — all texts, images, videos, logos, graphics, design, software code and other materials published on the Site.
- "Services" — the services the Administrator offers and presents through the Site: website development, SEO optimisation, Google Business Profile optimisation, advertising campaigns in Meta and Google, and other related digital services.
- "Contact form" — the form on the Site through which the User can send an enquiry to the Administrator.
5. Purpose of the Site
The Site is informational in nature and presents the Administrator and the Services it offers. Through the Site the User can:
- learn about the Administrator's activity and Services;
- send an enquiry or request a quotation through the Contact form;
- review examples of the Administrator's work and portfolio, where published;
- obtain contact information.
The Site is not an online shop with a product catalogue and online orders. Payments for Services already agreed may, however, be made online by bank card under the conditions in section 8.
6. Rights and obligations of the User
6.1. Rights
The User has the right to:
- browse the Site and the Content freely and free of charge;
- use the Contact form to send enquiries;
- receive a reply to an enquiry within a reasonable time;
- exercise their rights as a data subject under the Privacy Policy.
6.2. Obligations
The User undertakes to:
- use the Site in good faith and in accordance with these Terms, applicable law and good practice;
- provide true, accurate and up-to-date information in the Contact form;
- refrain from actions that may disrupt the operation or security of the Site;
- respect the intellectual property rights of the Administrator and of third parties.
6.3. Prohibited actions
When using the Site, the User is prohibited from:
- copying, reproducing, distributing or publishing Content without express written permission;
- using automated means, bots, scripts or scrapers to extract data from the Site in bulk;
- attempting unauthorised access to systems, servers or databases connected to the Site;
- distributing viruses, malicious code or other harmful software;
- sending unsolicited communication, spam, chain letters or advertising through the Contact form.
7. Contact form
Through the Contact form the User may send an enquiry to the Administrator. By sending an enquiry, the User:
- confirms that they have read the Privacy Policy and consents to the processing of their personal data for the purpose of answering the enquiry;
- warrants that the information provided is true and current;
- does not expect to receive a binding offer on the basis of the enquiry alone — quotations are prepared individually after discussing the specific project.
The Administrator makes reasonable efforts to answer every legitimate enquiry within a reasonable time, usually within 2 working days, but does not commit to a guaranteed deadline or to concluding a contract. Sending an enquiry does not by itself create contractual relations between the parties.
7.1. Chat assistant (artificial intelligence)
The Site offers a chat assistant that gives automated, informational answers, partly with the help of artificial intelligence. Those answers are indicative, are not a binding offer or professional advice, and may contain inaccuracies. Binding information and quotations are given in writing by a member of the Administrator's team after discussing the specific project. The User undertakes not to use the chat for unlawful, offensive or abusive purposes, and not to enter sensitive personal data. Processing of data through the chat is described in the Privacy Policy.
8. Card payments
Payment by debit or credit card through Pay by Link of DSK Bank.
- Accepted card types: debit, credit and business cards issued by Visa and Mastercard.
- Transactions are carried out through the MasterCard Identity Check and VISA Secure security programmes.
- We do not store data of the bank cards used for payment through the Site.
- Where an amount paid by bank card has to be returned, it is refunded to the card used for the payment.
Payment is made through an individually issued payment link after a specific Service has been agreed. The Site does not maintain a product catalogue and does not process card data itself — card details are entered in the secure environment of DSK Bank.
9. Withdrawal, complaints and refunds
9.1. Right of withdrawal for consumers
A consumer within the meaning of the Bulgarian Consumer Protection Act — a natural person acting outside their trade or profession — has the right to withdraw from a distance contract within 14 days without giving a reason. The period runs from the date the service contract is concluded.
Withdrawal is exercised by an unequivocal statement to the Administrator at office@digitaldesigneu.com or at the address in section 1. The standard form in Annex 6 to the Consumer Protection Act may be used, but is not mandatory.
9.2. When the right of withdrawal does not apply
Under Article 57 of the Consumer Protection Act, the right of withdrawal does not apply to:
- a service that has been fully performed, where performance began with the User's express prior consent and with their acknowledgement that they will lose the right of withdrawal once the service is fully performed;
- a service made to the User's specification or clearly personalised — which is the case with a website, design and copy produced to a specific brief.
Where the User has requested performance to begin within the 14-day period and then withdraws, they owe an amount proportionate to the work actually carried out up to the moment of withdrawal.
9.3. Payment in two parts
The fee for a project is paid in two parts: 50% at the start and 50% on completion and approval of the work. The deposit covers work already begun and is refundable only to the extent of the work not carried out, unless the individual agreement provides otherwise.
9.4. Complaints
Where a Service does not conform to what was agreed, the User may file a complaint within the period set by the Consumer Protection Act, describing the non-conformity and attaching proof of payment. The Administrator responds to a complaint within 30 days of it being filed. Revisions included in the chosen plan are not complaints and are carried out as part of the project.
9.5. Refunds
An approved refund is made within 14 days using the same means of payment used for the original transaction. Where payment was made by bank card, the amount is returned to that card — this is a requirement of the card schemes and cannot be replaced by another payment method without the User's express consent.
9.6. Alternative dispute resolution
In the event of a dispute, the User may contact the Commission for Consumer Protection or an alternative dispute resolution body. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
10. Intellectual property rights
All Content on the Site — including but not limited to texts, images, graphics, logos, design, structure, software code, video and audio materials — is owned by the Administrator or used with the permission of the respective rights holders. The Content is protected by the Bulgarian Copyright and Related Rights Act and by international intellectual property law.
Any copying, reproduction, distribution, publication, commercial use or creation of derivative works without the Administrator's express written permission is prohibited and may give rise to civil and criminal liability.
Trademarks, logos and service marks displayed on the Site are the property of their respective owners.
The User may print or download individual pages of the Site solely for personal, non-commercial use, provided that copyright notices are not removed.
11. Links to external sites
The Site may contain links to websites operated by third parties. The Administrator neither controls nor is responsible for the content, privacy policies or practices of those external sites. Visiting them is at the User's own risk.
12. Limitation of liability
The Administrator makes reasonable efforts to keep the Site in good technical condition and to provide accurate and current information, but:
- does not warrant that the Site will be continuously available, free of errors, viruses or other harmful components;
- is not liable for temporary unavailability due to technical reasons, maintenance, updates, force majeure or the actions of third parties;
- is not liable for damages arising from the use of, or inability to use, the Site, except where such liability cannot be excluded under mandatory provisions of the law;
- is not liable for the accuracy, completeness or currency of the information published on the Site, to the extent permitted by law.
The information on the Site is general and informational. It does not constitute a binding offer, professional advice or a recommendation. For decisions specific to your business, we recommend contacting us directly.
13. Force majeure
The Administrator is not liable for non-performance or partial performance of its obligations under these Terms where this is due to force majeure — events beyond its reasonable control that could not be foreseen or avoided with due care.
Such events include, but are not limited to: natural disasters, acts of war, terrorist acts, civil unrest, strikes, interruption of electricity or internet services, cyberattacks, pandemics and epidemics, as well as acts of public authorities.
14. Protection of personal data
The Administrator processes Users' personal data in accordance with the Bulgarian Personal Data Protection Act and Regulation (EU) 2016/679 (GDPR).
Detailed information on what personal data we collect, for what purposes, how long we keep it and what your rights are is available in the Privacy Policy published on the Site.
Information about the cookies used is set out in the Cookie Policy.
15. Amendments to the Terms
The Administrator reserves the right to amend and supplement these Terms unilaterally at any time. The current version is always available on this page, with the date it takes effect.
Continued use of the Site after amended Terms are published is deemed acceptance of them. We recommend reviewing this page periodically.
16. Termination of access
The Administrator reserves the right, at its discretion and without prior notice, to restrict or terminate access for a User who breaches these Terms or applicable law, or harms the interests of the Administrator or of third parties.
17. Governing law and jurisdiction
Matters not settled by these Terms are governed by the applicable law of the Republic of Bulgaria.
All disputes arising out of or in connection with these Terms and/or the use of the Site are resolved through negotiation between the parties. If no agreement is reached, the dispute is referred to the competent Bulgarian court under the Civil Procedure Code.
Users who are consumers within the meaning of the Consumer Protection Act may also turn to:
- the Commission for Consumer Protection — www.kzp.bg
- the European Commission's online dispute resolution platform — https://ec.europa.eu/consumers/odr/
18. Entire agreement and severability
These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between the Administrator and the User regarding the use of the Site, and supersede all previous written or oral arrangements on this subject.
If any provision of these Terms is found to be invalid, void or unenforceable for any reason, this does not affect the validity of the remaining provisions. The invalid provision is replaced by a valid one that is closest in meaning and purpose to the one replaced.
19. Final provisions
These Terms were drawn up in Bulgarian. This English text is a translation provided for convenience. In the event of any discrepancy between the Bulgarian version and a translation, the Bulgarian text prevails.
Nothing in these Terms limits the mandatory rights granted to the User by Bulgarian or European law.
